By downloading, installing, or using Nxive Sender, you agree to these Terms and Conditions. If you do not agree, do not use the application. Continued use after updates constitutes acceptance of the revised terms.
The Service
Nxive Sender is a free, open source file transfer application that enables direct device to device sharing over local networks. The software is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or noninfringement.
Eligibility
You must be at least 18 years of age to use Nxive Sender. By using the application, you represent and warrant that you meet this age requirement.
Your Responsibilities
You are solely responsible for the files you send and receive using Nxive Sender. You agree not to use the application to transfer illegal, harmful, or unauthorized content. We do not monitor, inspect, or store any transferred files.
Intellectual Property
Nxive Sender is built on open source foundations. The original core engine is developed by independent contributors under its respective license. The interface, branding, identity, and all visual design elements are the intellectual property of NXIVE.
No Warranties
The application is provided without warranty regarding uninterrupted operation, accuracy, reliability, or performance. We do not guarantee that the software will meet your specific requirements or that defects will be corrected.
Limitation of Liability
To the maximum extent permitted by applicable law, NXIVE and its contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application. Our total liability shall not exceed $100 USD.
Third Party Services
Nxive Sender may contain links to third party websites or services. We do not control and are not responsible for the content, privacy policies, or practices of any third party sites or services.
Termination
We reserve the right to terminate or suspend access to the service at any time, without prior notice, for conduct that we believe violates these terms or is harmful to other users or the project.
Governing Law
These terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions. Any disputes shall first be attempted to be resolved informally before pursuing formal legal action.
Changes to Terms
We may update these terms from time to time. Material changes will be communicated by updating the date at the top of this page. Your continued use of Nxive Sender after changes constitutes acceptance of the new terms.
